Dear Mr. Evans,
 
I am in receipt of your letter, dated September 4th, 2002.
 
As you may expect, I have several reservations about your requests.
 
 
 

1. The domain name troublebenz.com.
My 8th. Mercedes was a lemon - no doubt, even representatives from Mercedes and Lone Star Inc. (Calgary) do not deny this. Since there is no lemon-law in Canada, as far as I know, we call it here 'trouble'.. so I had a lot of trouble with a Mercedes Benz.. what is wrong with the name troublebenz? I found websites http://www.mercedesproblems.com, http://www.mercedes-lemon.com, http://www.mercedesproblems.com.ar, and a bunch more. It is common practice on the internet to choose a name, which will describe in a short way what an author wants to say about a web site. I want to express the trouble I had with a Benz.
 
2. The three-pointed star
Ok, I used your client's emblem and put it upside down. I believe I met your request, by placing instead of the Mercedes Bens emblem a part of my car on the web - and I do not think that there is anything wrong with that. Here is a quick step-by-step instruction:

... and I don't think that there is anything wrong by putting a picture of a part of my car upside down on the web.. If you do not agree with it, please let me know.
 
3. Overall look and feel
My last experience with Mercedes Benz was anything but colourful. It was sad and disappointing - so what is closer but to use greytones for the web design. I didn't put the clouds in... they would have to be really black.
 
If you ask a web designer, please let him/her have a look at the HTML code of both sites. They are totally different. And if you talk to them, please ask also if it is common practise to use horizontal and vertical menu items - In the case of http://troublebenz.com they are actually embedded pages. I am using this kind of navigation tools for years.. i.e. http://ergodynamicsolutions.com/old, http://sportfisherman.net, just to mention two.
 
If you are referring to the use of the red arrow... this arrow is being used for years and freely available on the web.. I use it for http://eaglepc.com/pc for some time myself. I did not go through the trouble to compare the graphic pixel by pixel, but unless Mercedes Benz's web designer and I have the same source, there should be a difference.
 
4. Photographs
Look at it this way - by using the copied pictures, the paint is actually shiny not dull like the Mercedes paint jobs look like after 3 years. I will take some pictures and will replace them with the ones being used on the web site now. I am positive, that you will have no objections, that I take everything surrounding the vehicle out to put the attention to the flat paint job and the bright lemon.
 
Just in case that Lone Star Inc. (Calgary) will complain about using their pictures of their shop, I drove by today and took some of my own, which will replace the currently used ones; although I do not believe it will effect in any way the appearance of the site.
Attached, you will find a jpg file of a fax I sent to Lone Star Inc. (Calgary), asking for the complete service records. Unfortunately, this fax remains unanswered. I stated on several pages, that I am trying to be as objective as possible - hard to do with any co-operation from the other side.
 
The vehicle in question is due to be turned in and I have a last high-resolution photo session about shape etc.. The way Mercedes Benz and Lone Star Inc. (Calgary) treated me in past - I expect more trouble. I used the web page so far just to keep track of the instances and to mark down the dates and details of the last problems I had. If I would have all the service records, I could be far more accurate.. and btw - I believe they should have been given to me at the time the repairs were done - but you are the lawyer.
 
The fact that there are web sites all over the world about the decreasing quality of MB products, the fact that even in Germany the GM-daughter Opel is rated higher than Mercedes Benz in regards of quality (MB does not like, that this information got out, but it is all over in German newspapers) should make MB think about their reputation. I was not mad that I got a lemon, I got mad about the way I was treated.
